Why we are proposing changes

We believe that retail consumers can’t reliably assess the value and risks of derivatives (contracts for difference, futures and options) and exchange traded notes (ETNs) that reference certain cryptoassets. This is due to the:

• inherent nature of the underlying assets, which have no reliable basis for valuation
• presence of market abuse and financial crime (including cyberthefts from cryptoasset platforms) in the secondary market for cryptoassets
• extreme volatility in cryptoasset prices movements
• inadequate understanding by retail consumers of cryptoassets and the lack of a clear investment need for investment products referencing them

We think these issues will cause retail consumers harm from sudden and unexpected losses if they invest in these products. We estimate a ban could reduce harm by £19m to £101m a year for retail investors.

• firms distributing products referencing cryptoassets, including brokers and investment platforms, and financial advisers

Although some people regard stealing and embezzlement as the same thing, there are some key differences in the eyes of the law.

Stealing refers to taking someone else’s property or money without their permission. An example of this would be taking money from a store or stealing money from a friend’s wallet. Anyone arrested for an offense like this could face theft charges and the legal consequences that come with it.

Embezzlement is a misappropriation of funds. Usually, a person in a position of trust with financial responsibility and the confidence of their employer faces this charge. They may embezzle funds by creating fake invoices, forgery, over-billing suppliers and customers, or in another manner. Although embezzlement is a form of stealing as a trusted employee, the perpetrator abused that trust, and this is the key difference between the two crimes.
